Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Jackalope Technologies, Inc., the company that operates the Low Ocean service ("Low Ocean," "we," "us"), governing your access to and use of the Low Ocean service, including any pages you create and the links you publish (the "Service").
By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms incorporate by reference any policies we link from within them. Where a separate policy and these Terms conflict, these Terms control unless the policy says otherwise. Our Privacy Policy describes how we collect, use, and retain personal data — including emails, IP addresses, and the contents of reports — and is incorporated by reference.
2. Eligibility
You must be at least 13 years old — and at least the minimum age required in your country or region to consent to the use of online services — and capable of forming a binding contract to use the Service. If you are under 18, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. If you use the Service on behalf of an organization, you represent that you are authorized to bind it, and "you" includes that organization.
3. Your account
You are responsible for your account, for keeping your credentials secure, and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use. We may require identity or eligibility verification, and may refuse, reclaim, or rename a username (for example, where it infringes a trademark or impersonates another).
4. The Service, and changes to it
We may add, change, suspend, or discontinue features of the Service at any time. We aim to keep the Service available but do not guarantee uninterrupted access.
5. Your content
You own your content. You retain ownership of the content you publish — your username, display name, biography, images, and links ("Your Content"). We do not claim ownership of it.
You grant us a license to operate the Service. You grant Low Ocean a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content as necessary to operate the Service. We will not use Your Content, name, or likeness in external marketing or advertising without your consent — except to display or link to your public page substantially as it already appears. This license ends when you delete Your Content or your account, except for content already shared with others, content we must retain to comply with law, and backups retained in the ordinary course.
Your responsibility and representations. You are solely responsible for Your Content and for everything your links lead to. You represent that you have the rights necessary to publish Your Content and that it does not violate these Terms or any law.
6. Third-party links and destinations
The Service exists to route visitors to destinations you choose. We do not control, endorse, or assume responsibility for third-party websites, content, products, or services reached through your links. Your use of any linked destination is at your own risk and may be governed by that third party's own terms. Two things that may seem in tension are not: not being responsible for a destination and reserving the right to act on a page because of where its links lead are separate. We choose what our Service routes people to — and may decline to route, or remove a page, based on its destinations under Section 7 — without thereby assuming responsibility for those destinations or a duty to monitor them.
7. Acceptable Use
This Section defines what is not permitted on the Service. It applies to everything associated with your page — your username, display name, biography, images, and other on-page content, and the destinations your links point to. A page whose own text is innocuous but whose links lead to prohibited material violates these Terms. We may evaluate, and act on, the full experience a visitor encounters by following your page, including destinations that change after you publish.
The categories below are not exhaustive. Each operates on an "including but not limited to" standard: the examples illustrate the category; they do not define its outer limit. Conduct that fits the substance of a category is covered whether or not it is specifically listed.
7.1 Illegal content and activity
Content or conduct that violates any applicable law or regulation, or that facilitates, promotes, or instructs others in unlawful acts. This is an independent ground, separate from every category below.
7.2 Child safety
We have no tolerance for content that sexualizes, endangers, or exploits minors. Strictly prohibited, without exception: child sexual abuse material (CSAM) in any form; sexualized depictions of minors, whether real or generated; sexualization of minors in text, images, or links; grooming, solicitation, or any attempt to facilitate sexual contact with or exploitation of a minor; and content that otherwise endangers a child.
Violations result in immediate, permanent account termination. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement and preserve associated material as required by law.
7.3 Fraud, scams, and financial deception
Content or links designed to deceive people out of money, credentials, or personal information, or to misrepresent the nature or value of an offering. Includes phishing and credential harvesting; fake giveaways, lotteries, or prize claims; advance-fee and "send X, get more back" schemes; cryptocurrency and investment scams, including guaranteed-return or "passive income" schemes; deceptively presented pyramid, Ponzi, and multi-level-marketing schemes; counterfeit goods and non-delivery schemes; and deceptive "free," offer-wall, or subscription-trap schemes.
7.4 Impersonation and misrepresentation
Falsely presenting yourself as another person, brand, organization, or as Low Ocean, or otherwise misrepresenting your identity or affiliation in a way likely to deceive. Parody, satire, and fan pages are permitted only where clearly and unambiguously labeled and not used to deceive, defraud, or harass.
7.5 Spam, inauthentic behavior, and platform manipulation
Using the Service to distribute unsolicited bulk content or to manipulate the platform or its visitors. Includes mass-created pages; link farms and pages built only to manipulate search or routing; deceptive redirects and cloaking; artificial or purchased engagement; bot-operated accounts; and aggressive or repetitive off-platform solicitation under false pretenses.
7.6 Malware, phishing, and technical abuse
Content, links, or behavior that compromises security or interferes with the Service. Includes links to malware, spyware, ransomware, or drive-by downloads; phishing and credential-harvesting destinations; deceptive download prompts; and any attempt to probe, scan, overload, disrupt, scrape at scale, or circumvent the security, rate limits, or access controls of the Service or its users.
7.7 Intellectual property
Content that infringes the copyrights, trademarks, or other intellectual-property rights of others, including unlicensed use of protected works, counterfeit goods, and unauthorized use of brands, logos, or trade names. We respond to valid infringement notices under Section 8 and maintain a repeat-infringer policy.
7.8 Adult and sexual content
Sexually explicit and pornographic material, whether on-page or reached through your links, is not permitted on public pages. Always prohibited regardless of any other setting: non-consensual intimate imagery; content that sexualizes minors (Section 7.2); and content that facilitates sex trafficking or commercial sexual exploitation.
7.9 Violence, threats, and dangerous organizations
Content that threatens, incites, glorifies, or coordinates violence, or that supports violent or criminal organizations. Includes credible threats; incitement to violence; terrorist or violent-extremist content, propaganda, or recruitment; glorification of mass violence; and instructions for weapons or devices intended to cause mass harm.
7.10 Hate and harassment
Content that attacks, degrades, or dehumanizes people based on protected characteristics (such as race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, or serious disease), and content directed at individuals to harass, bully, intimidate, or threaten, including the malicious release of private information (see also Section 7.13).
7.11 Self-harm and dangerous activities
Content that promotes, encourages, or provides instructions for suicide, self-harm, eating disorders, or other behavior likely to cause serious physical harm, or that promotes dangerous challenges. Supportive, recovery, and resource content is permitted; promotional or instructional content is not.
7.12 Regulated and prohibited goods and services
Content or links that sell, facilitate, or promote goods and services that are illegal or restricted, including illegal drugs and controlled substances; unauthorized pharmaceuticals; weapons, firearms, and explosives where prohibited; trafficked or stolen goods; human trafficking; protected wildlife; counterfeit currency or documents; and unlicensed gambling. Lawful age-restricted goods, where permitted, must comply with all applicable age-gating and jurisdictional rules.
7.13 Privacy and personal information
Publishing or linking to another person's private or identifying information without consent ("doxxing"), or content that facilitates stalking, surveillance, or harassment, including home addresses, private contact details, government identifiers, financial account information, and intimate images shared without consent.
7.14 Deceptive and harmful misinformation
Demonstrably false content likely to cause real-world harm, including dangerous health and medical misinformation, manipulated or synthetic media presented as authentic to deceive, and content intended to deceive people about how, when, or whether to vote.
7.15 Linked and off-platform content
Because your page exists to route people elsewhere, you are responsible for where your links lead. Linking to any content or destination that would violate these Terms if hosted on the Service is itself a violation. We may review link destinations and act on a page based on what those links lead to — including destinations that change after publication, malicious redirects, and shorteners used to obscure a prohibited destination.
7.16 Circumvention and enforcement evasion
Attempting to evade our enforcement, including creating new pages or accounts to restore content or presence we removed or suspended; operating multiple accounts to dodge limits or actions; obscuring prohibited content to avoid detection; and using the Service to circumvent another platform's ban.
7.17 Platform integrity and abuse of the Service
Conduct that abuses, degrades, or threatens the Service, its staff, its systems, or its users, including providing false information at signup or verification; abusing the reporting system (including mass or bad-faith reports intended to harass another user or burden our review); abusive conduct toward staff; and any use of the Service that materially harms Low Ocean, its users, or its reputation.
8. Reporting and copyright (DMCA)
Anyone can report content that may violate these Terms through the Report this page link on any public page. We review reports and act under Section 10.
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. Notices and counter-notices should be sent to our designated Copyright Agent: Copyright Agent, Jackalope Technologies, Inc., work@jackalo.pe. We will, in appropriate circumstances, terminate the accounts of repeat infringers.
9. Payments and payouts
Where the Service enables payments or payouts, you agree to the applicable fees and to our payment processor's terms. We may withhold, reverse, or refuse payouts where a transaction or account is implicated in a violation of these Terms, is subject to a chargeback or legal hold, or where required by law or our payment processor. You are responsible for any taxes on amounts you receive.
10. Enforcement and termination
Actions we may take. Depending on the severity of a violation, your history, and the risk to others, we may take any of the following actions, in no required order: issue a warning; remove specific content or links; place a page under review; suspend (hide) or take down (remove) a page; restrict account features; suspend or permanently terminate your account; withhold, reverse, or refuse payouts under Section 9; and report unlawful activity to the authorities. We are not required to use the least-severe action first, and repeated or escalating violations may result in permanent termination.
Basis for action. We may act on reports, our own detection (automated or manual), the requirements of law or legal process, or the requirements of our payment, hosting, and infrastructure providers.
Notice and reasons. When we take action against your page or account, we will provide notice and a statement of the reason, identifying the relevant Section and how to appeal, except where providing notice is impractical, would create a security or safety risk, or is prohibited by law — including in matters of child safety, imminent harm, active fraud, or malware, where we may act immediately and without prior notice.
Effect of termination. On termination, your right to use the Service ends and we may delete or retain Your Content consistent with Section 5 and applicable law. Sections that by their nature should survive — including 5 (your content license terms that outlast the account), 7, 8, 9 (payment, chargeback, and payout-clawback terms), 11, 12, 13, 14, and 15 (governing law and dispute resolution) — survive termination.
Your right to stop. You may stop using the Service and delete your account at any time.
11. Appeals
Most enforcement actions can be appealed. If your page or account has been actioned and you believe we were wrong, you may request a review through the appeal instructions included in the enforcement notice you received, or by contacting us under Section 18 with the subject line "Appeal." We will review appeals in good faith, by a person rather than by automated means alone, and respond. Some decisions — particularly those involving child safety or legal obligations — may not be eligible for reversal.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any linked destination is safe or lawful. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Low Ocean will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim or (b) USD $100. Nothing in these Terms limits liability that the law does not allow us to limit — including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence. Some jurisdictions do not allow certain limitations, so parts of this Section may not apply to you.
14. Indemnification
You agree to indemnify and hold Low Ocean harmless from third-party claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your links, your violation of these Terms, or your violation of any law or third-party right. This indemnity does not cover losses to the extent caused by Low Ocean's own fault, and applies only as permitted by applicable law — some consumer-protection regimes limit or bar indemnities of this kind.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules.
Talk to us first. Before filing any claim, you agree to first contact us under Section 18 with a written description of the dispute and give us 30 days to try to resolve it informally. Most concerns can be resolved this way.
Where disputes are resolved. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and you and Low Ocean each consent to personal jurisdiction and venue there. Either party may instead bring an individual claim in small-claims court in its jurisdiction if the claim qualifies.
16. Changes to these Terms
We may update these Terms. For material changes, we will provide reasonable notice — for example, through the Service or by email — before they take effect. For routine changes, your continued use of the Service after they take effect constitutes acceptance. For changes that materially reduce your rights or add materially adverse obligations — for example, a new arbitration clause or class-action waiver — we will seek your affirmative agreement, and continued use alone will not be treated as acceptance of those changes. If you do not agree to a change, you may stop using the Service and delete your account.
17. Miscellaneous
These Terms, plus any policies incorporated by reference, are the entire agreement between you and Low Ocean regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
